NA approves amended Constitution

The amended Constitution is divided into 11 chapters with 120 articles, one chapter and 27 articles fewer than the previous version.


According to a report summarizing NA deputies’ suggestions, for Article 51 on building and developing the socialist-oriented market economy and economic sectors, some 368 out of 408 deputies agreed, 20 disagreed and 20 others didn’t give any feedback.


NA vice chairman Uong Chu Luu said in the report that some deputies suggested eliminating the regulation that “The State economic sector plays the leading role in the socialist-oriented market economy” or specific regulations that clearly define the State economic sector.


The Committee for Drafting Amendments to the 1992 Constitution continues to confirm the essential path to build Vietnam’s socialist-oriented market economy is economic sectors, which are important components of the national economy. The regulation does not influence operations of the market economy and roles of other economic sectors.


Besides, the State economic sector includes many factors and resources and State-owned enterprises are just one of these factors. Therefore, the committee said that it is not necessary to make specific regulations for the State economic sector.


Concerning Article 54 on land recall, there were 338 deputies who said ‘agree’, 43 ‘disagree’ and 27 failed to provide feedback.


Explaining the problem, Luu said that given current development conditions, it is still necessary to revoke land to carry out socio-economic development projects. However, to avoid disputes during land recall, the Constitution must regulate land recall for the sake of national interests and public benefits.


Therefore, the committee suggested the NA to maintain the term no. 3 in this article, allowing “the State to recall land used by organizations or individuals in highly-necessary cases specified by the law for the sake of national defense, security, national interests, public benefits, and for socio-economic development.”


Nguyen Sinh Hung, NA chairman and chairman of the Committee for Drafting Amendments to the 1992 Constitution, admitted that different viewpoints remained on some articles of the draft but a majority of people and the NA reached a high level of consensus on the document. Other differing opinions will continue to be heard and studied on the path of national renewal, he said.


After adopting the draft, lawmakers also passed a resolution on the enforcement of the amended Constitution. The draft has been completed after 11 months of collecting feedback from legislators and the public.
