Improving the Effectiveness of Labour Law Enforcement

The Ministry of Labour, Invalids and Social Affairs in collaboration with the International Labour Organisation (ILO) organised a short training course on new contents of the Labour Code 2012 for reporters working for news agencies in Hanoi, Ho Chi Minh City and Da Nang.

The Labour Code 2012, which consists of 17 chapters and 198 articles, takes effect from May 1, 2013. The new law increases flexibility for employers and gives more power to local authorities in the settlement of labour disputes. The event also covers contents concerning personal dispute settlement specified by the Civil Procedure Code.

Mr Dang Duc San, Head of the Legal Department under the Ministry of Labour, Invalids and Social Affairs, said the new law has more than 100 new contents compared to the replaced one, with one of the most notable contents being labour sublease contract. This is a new, flexible but complex form of labour and is a supplement to traditional labour market.

Attendants listened and discussed major changes in the Labour Code 2012, including labour contract (labour sublease, contract type, employment and severance), salary structure, sexual harassment in the workplace, discrimination in the workplace, trade union rights of workers, collective bargaining, collective bargaining agreement, dispute resolution, and industrial action.
