New Labour Code strives to protect employee rights

Deputy Minister of Labour, Invalids and Social Affairs Pham Minh Huan spoke with Thoi bao Kinh te Viet Nam (Vietnam Economic Times) about the new Labour Code.


What has the ministry done to make the new Labour Code a reality?


After the National Assembly approved the 2012 Labour Code, MOLISA organised several meetings with relevant ministries and sectors to discuss compiling instructions for the code’s implementation.


Now 10 draft decrees and eight circulars are on the Prime Minister’s table waiting for approval.


In addition, we have consulted the National Assembly Standing Committee about our proposal to allow the government to add further details to some of the articles and paragraphs in the code to make it easier to implement.


Starting in May, MOLISA will work with relevant agencies to disseminate the new Labour Code to both employees and employers.


What new points are contained in the 2012 Labour Code?


The 2012 Labour Code covers a wide range of adjustments relating to both employees and employers. Some articles and paragraphs in the law only contain general principles, so we need a government decree to indicate how they will be implemented.


During the process of developing these guiding documents, we consulted enterprises, offices, organisations and ordinary people – particularly working people – hoping that when they read the law, they will interpret the wording correctly and implement the new principles.


Another point I want to mention here is that the new Labour Code has successfully encapsulated the goals of the Party for moving down the path of national construction and is in line with the revision of the 1992 Constitution.


The new law contains many new ideas. It specifies how to void a labour contract signed between an employer and employee, how to create a labour sublease contract and how to conduct dialogues in the workplace.


The code also deals at length with the protection of employees’ rights, including the rights to join professional associations, collective negotiations and collective labour agreements and to receive a minimum wage.


In your opinion, what role will the trade union play in the new law?


The Viet Nam General Confederation of Trade Unions nationwide play a very important role in the implementation of the new law, particularly in the reconciliation process between employers and employees during disputes.


Trade union leaders are very active in protecting employees’ rights. And they play an important role in maintaining harmonious relationships between employees and their employers. This is a key factor contributing to defusing disputes in many enterprises. — VNS
