Applying Unified ODA Bidding Documents

At a conference on Bidding Law No. 43/2013/QH13 hosted by the Ministry of Planning and Investment on February 13, 2014, Director Le Van Tang of Procurement Management Department said ODA donors agreed to apply a standard set of bidding documents for projects funded by official development assistance (ODA). The new set of documents, which will be created by the Ministry of Planning and Investment, is expected to be completed and issued at the end of this year.


This is an important step to address the huge difference in procedures – a considerable obstacle to ODA projects – as donors see that Vietnam’s tender legal system has approached international regulations. “Currently, each donor still has its own rules and procedures for its projects, which are different from those of Vietnam and other donors,” he said.


Director Tang added that the Bidding Law 2013, which takes effect on July 1, 2014, achieved 10 basic goals like simplified administrative procedures in bidding; clear definition of bidding document assessment methods in specific fields; priority for domestic human resources development; regulations on centralised procurement bidding forms; procurement of medicines and medical supplies; and others. The law also stipulates clear regulations on investor selection, strict regulations on contract enforcement; drastic decentralisation; and intensified supervision in tendering.


He underlined the objective of intensified supervision in bidding and cited active and positive roles of press agencies. The new law adds community supervision over contractor selection and contract enforcement, supplements supervisory responsibility of persons and agencies in charge of bidding; and specifies personal responsibility for every activity in bidding process.


The new law also adds regulations on some prohibited acts and on penalties and treatments on persons authorised to impose penalties but refused to do. Additional fines are also specified in the law, including public disclosure of violation acts on Tender Newspaper, on national tender network, or mass media.
