Deputy Minister of Construction Nguyen Tran Nam showed up at the press briefing after the Government’s regular meeting last week, so he was expected to give an apology for the problem. However, Nam refused to do so.
Nam said the circular provides for two different methods of measurement of an apartment: that of the usable floor space and that of the total area inclusive of walls and electrical boxes, elevators and hallways. This provides two separate measuring systems, so investors and customers can negotiate to choose the most suitable method.
Earlier, the National Assembly’s Legislation Committee had said that the ministry’s issue of Circular 16 was not legitimate.
Most investors have chosen to measure condos in the latter way with the area of walls and electrical boxes, elevators and hallways included. Therefore, many homebuyers have to pay for the areas they cannot use.
Many disputes have occurred given the controversial circular while the ministry in such disputes concluded that all investors were right.
Since April 8, the ministry will remove the measuring method given the newly-issued Circular 03.
Nam said that the ministry will just bear responsibility for not explaining Circular 16 clearly to citizens.
During implementation of the circular, some enterprises might have not followed instructions of managing agencies while using loopholes to cheat clients. If homebuyers do not agree at their measurement method, they can cancel contracts or bring the case to the court, Nam added.
