Vietnam inks deals with Permanent Court of Arbitration

Vietnamese Deputy Minister of Foreign Affairs Ho Xuan Son and Secretary-General of the Permanent Court of Arbitration (PCA) Hugo Hans Siblesz have signed the Host Country Agreement and Exchange Letters on Cooperation between the local government and the PCA.



Under these documents, which were signed in Hanoi on Monday, Vietnam officially recognizes the PCA’s legal status in taking peaceful measures to settle international conflicts through arbitration, intermediaries, reconciliation, and an investigation council.



The PCA, an intergovernmental organization providing a variety of dispute resolution services for the international community, will also supply other necessary assistance related to peacefully resolving international disputes in Vietnam.


Also according to the signed instruments, the Vietnamese government will facilitate such acts by the PCA in Vietnam.


In return, the court will provide information and consulting for the Vietnamese government about procedures in the international arbitration monitored by the PCA.


It will also help Vietnam train and enhance the capacity of Vietnamese legal staff.


The PCA was established in 1899 to facilitate arbitration and other forms of dispute resolution between states.


It has since developed into a modern, multi-faceted arbitral institution that is now perfectly situated at the juncture between public and private international law to meet the rapidly evolving dispute resolution needs of the international community.


Today the PCA, with 115 member states, provides services for the resolution of disputes involving various combinations of states, state entities, intergovernmental organizations, and private parties.


The PCA has jurisdiction to settle all kinds of disputes, including territorial ones, between its country members, said Mac Thi Hoai Huong, an expert in international law at the Hanoi Law University.


For its territorial dispute with China, the Philippines has filed a lawsuit at the PCA.


Also on Monday, Deputy Prime Minister and Foreign Minister Pham Binh Minh met with Secretary-General Hugo Hans Siblesz.


The Vietnamese official highly valued the role of the PCA in supporting countries to deal with international disputes by means of peaceful measures.


He also expressed his hope that the signing of the documents which recognize the court’s legal status in Vietnam will help promote bilateral cooperation between the two sides.
