Nine ministries signed the Program on Action Coordination and Fight against Intellectual Property Infringement, period II (2012-2015)

After 5 years implementing the Action Program No. 168/CTHĐ/VHTT-KHCN-NN&PTNN-TC-TM-CA on cooperation in the fight against intellectual property infringement, period 2006-2010, aka the Action Program No. 168., jointly signed by the Ministry of Science and Technology, the Ministry of Culture and Information (now the Ministry of Culture, Sports, and Tourism), the Ministry of Agriculture and Rural Development, the Ministry of Finance, the Ministry of Commerce (now the Ministry of Industry and Trade), the Ministry of Public Security, the Ministry of Post and Telecommunications (now the Ministry of Information and Communications), there has been considerable progress in law enforcement and protection of intellectual property rights. Specifically, the development and issuance of legal documents in this area has been very active and better meet the demand of the international integration process.


With the consensus of all signing ministries, the Ministry of Science and Technology held on June 12, 2012, a conference on a 5 year review of the program implementation and lessons learned from the implementation process to improve the quality of coordination among relevant ministries and local authorities in intellectual property rights enforcement. During the conference, relevant ministries attached high value to the achievements of the past period and agreed on the need to apply those results through an action coordination program, period II. On August 06, 2012, nine ministries including Ministry of Science and Technology, the Ministry of Culture, Sports, and Tourism, the Ministry of Agriculture and Rural Development, the Ministry of Finance, the Ministry of Industry and Trade, the Ministry of Public Security, the Ministry of Information and Communications, the Supreme People’s Court, and the Supreme People’s Procuracy signed the Action Coordination Program No. 2198/CTHĐ/BKHCN-BVHTTDL-BNNPTNT-BTC-BCT-BCA-BTTTT TANDTC-VKSNDTC on preventing and fighting against intellectual property rights infringement, period II (2012-2015). This could be regarded as the Action Program 168, period II, which added two additional members, the Supreme People’s Court and the Supreme People’s Procuracy.


The Action Program 168 period II had some new features compared to the Action Program 168 period I. This program would focus on the commitment of relevant agencies in stepping up information exchange activities, especially, would set up a mechanism for providing information about each ministry’s intellectual property rights enforcement. Under this mechanism, a database and website would be developed for relevant ministries to post information related to typical intellectual property right infringement cases that had been handled. At least once article a month or two to three typical cases a quarter on intellectual property rights enforcement in the area under each ministry’s management responsibility must be posted on the jointly run website. A standing board of the program would be set up, which included representatives from relevant ministries. The Inspectorate of the Ministry of Science and Technology would be appointed as the standing body of the board, charged with tasks assigned by the board. Besides, relevant ministries were also committed to strengthening coordination with each other in inspecting, examining and handling violations; strengthening education and communication activities; increasing training cooperation; enhancing implementing staff’s capacity and boosting international cooperation in intellectual property.


That the ministries signed the Action Coordination Program on preventing and fighting against intellectual property rights infringement, period II (2012-2015), once again confirm the determination of Vietnamese state authorities in carrying out effective activities to strengthen intellectual property rights enforcement and more effectively fulfill Vietnam’s commitment upon its admittance to the WTO.
