Draft Decree on Environmental Protection Planning

​In the afternoon of July 24, at the headquarters of the Ministry of Natural Resources and Environment, the Deputy Minister Bui Cach Tuyen chaired the meeting of the Editorial Team and the Drafting Committee of the Draft Decree on environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plans.



New Draft decree when issued will replace the Decree No.29/2011/ ND-CP.


Accordingly, the new Decree will include 6 chapters and 20 articles, onechapter and 21 articles less than the Decree No. 29/2011/ ND-CP.The draft Decree stipulates new content on environmental protection planning. It will replace the chapter of environmental protection commitment in the territory of the Socialist Republic of Vietnam with the chapter of environmental protection plan.


At the meeting, members of the Drafting Committee and the Editorial Team commented on the chapter of environmental protection planning.Accordingly, many participants argued that in the draft decree, it needs to clarify the inheritance of previous planning, so that the environmental planning should follow the plannings of other industry and sectors.For provision on the establishment of environmental protection scheme, many delegates suggested that it should review the extended time for all production, business and services establishment which having environmental impact assessment report, environmental protection commitments not been approved. Currently, the Draft Decree proposes the extension period at least three (03) years from the date this Decree takes effect.


Besides, the delegates also proposed to carefully review the list of projects subject to environmental impact assessments;list of subjects which do not require for registration for environmental protection plan; list of projects having the environmental impact assessment reports which are appraised and approved by the Ministry of Natural Resources and Environment.
